Trysedalia Driver App Privacy Policy

2. How we collect your information

We collect your personal information from:

  • your employer - when you apply to your employer to ride for TrySedalia, they will tell us who you are and confirm you meet all our requirements. We may also ask your employer to provide us with copies of the information they have about you.
  • you - when you interact with us, such as when you go through the onboarding process, browse or use the Driver App/s, if you complete our surveys, questionnaires or contact us by email, phone, post, text or in-app messages or use the chat function on our Driver App/s). We may also ask you to provide us your personal information so we can independently confirm and check that you meet our requirements, and/or compare it with the information your employer has told us about you so we can check and audit them.
  • the Driver App/s and your device/s - when you use Driver App/s we collect information about your use of them, including about your Driver online status (i.e. whether you’re able to accept deliveries or not) when using the Driver App and (when online) your order progress swipes as well as technical information.

3. What kind of information we collect about you

As part of our commitment to your privacy we want to be clear about the types of information we collect. We collect:

  • Information about who you are and how you meet Driver requirements, for example:
    • your name;
    • contact details (such as email address, address and phone numbers);
    • the vehicle you use when riding with TrySedalia, including the type of driving licence you hold (i.e. whether you are licenced to drive a car, a bike or both), the vehicle’s insurance and registration details reflecting the vehicle’s information as registered in Kuwait’s Ministry of Interior;
    • date of birth;
    • postcode;
    • your right to work (including visa information);
    • accommodation details including photographs, where necessary;
    • whether you are currently a Driver or if you’ve been a Driver in the past;
    • any changes you make to your Driver account profile in the Driver App/s;
    • your employer; and
    • any other information your employer shares with us so we know who you are and can set you up to ride with TrySedalia.
  • Sensitive personal information to verify your identity, for example:
    • photos or videos of you (“selfies”) and your identity documents;
    • identification documents that reflect your identity in accordance with the laws and regulations in the State of Kuwait, (e.g. a copy of your passport, civil identification card, driver licence, proof of address and any background and right to work checks that may have been carried out or provided to your employer);
    • working visas or other permits required to work for your employer, that may have been carried out by your employer or you); and
    • any other information we might need to verify your identity or that you meet our requirements
  • See the section “How and why we use your information” below for more details on how and why we use sensitive personal information to verify your identity.
  • Information about your deliveries and the services you provide to us. We record details of:
    • your deliveries, including a record of orders or services performed by you, your use of the Driver App/s and order progress swipes;
    • your contact with us, including emails, phone calls, post, chat or other form of contact with us. Your calls to Driver Support and Customer Services may be recorded for training and improvement;
    • your earnings, including a record of fees for the deliveries you’ve made. From time to time, we may also ask you to provide information about how and how much you’ve been paid by your employer, so we can carry out audits and checks;
    • incident information, including any information or reports we receive from you, our partners (“Partners”), customers and other members of the public that you may have encountered with whilst riding with TrySedalia, as well as information about any incidents you may have been involved in or are aware of; and
    • your orders, including any information you provide if and when registering for or ordering any kit, or taking offers from TrySedalia or partners, including what you ordered and your delivery address.
    • information you give us when you participate in things like competitions, prize draws, promotions, Driver events, our scholarship program or online courses or our partners’ services, if available.
  • Please note, when you use websites or applications of third parties in connection with your services for TrySedalia, including during the application and onboarding process, those sites or applications (which may include advertising or social media platforms) may also collect and process your information independently of TrySedalia. TrySedalia has no control over the privacy practices or the content of any of our business partners, advertisers, sponsors. Therefore, you are obliged to check the related third-party’s privacy policy and terms of use when visiting any other websites, and TrySedalia is not responsible for the above mentioned
  • Information about your location:
    • When you request to use a location-based function in the Driver App, (i.e when you want to find a zone centre or use the zone selector control, we access your location from your device in order to provide this functionality). You consent to this by opting to use these functions whilst your status is set to ”offline” i.e. not available for orders. In the event that you do not want us to have access to your location when you are “offline” and not exercising TrySedalia’s services via the Driver App, please do not request the “use a location functions” indicated therein
    • When your status is set to “online” (i.e. available for orders) in the Driver App, we collect your location data on a continuous basis so we can manage TrySedalia services (including tracking orders, pickups and deliveries). If you do not want us to view your location, please change your Driver status to "offline", However you must be online in the Driver App to accept and/or complete orders.
  • Unless you request to use a location-based function or set your status to “online” in the Driver App, we do not access or otherwise collect your location data.
  • Technical information about your device including characteristics of and performance data about
    • your device;
    • the Driver App/s;
    • your operating system;
    • your device type;
    • device ID;
    • network connection type;
    • app version;
    • phone language;
    • screen size;
    • platform;
    • your usage and interaction with the Driver App; and
    • internet connection.

4. How and why we use of your information

We will only process your information if there is a reason for doing so, as per the Communication & Information Technology Regulatory (“CITRA”) Resolution No. 42 for the year 2021 and the amendments related thereto with regards to data protection and collection of information

5. Automated decisions

In this Privacy Policy, we’ve provided a number of examples to explain when we use automated decision-making, like assigning orders efficiently, calculating fees and to help us identify suspected fraud or breaches of our policies. If an automated decision could significantly affect you, you can contact Driver Support to discuss the opportunity for a human review.

6. Data transfers

The information we collect about you will be transferred to and stored on our servers located in Kuwait. In some cases the information is processed outside Kuwait. These countries may not have the same laws or protections as we do in the Kuwait but we will comply with all laws applicable to privacy and data collection in Kuwait and take all steps reasonably necessary to ensure that there are appropriate safeguards in place to protect your information and that it is treated securely and in accordance with this Privacy Policy and applicable laws when it is transferred to those countries.

7. Retention of your information

We will only retain your information for as long as we reasonably need it to fulfil the purposes we have described in this Privacy Policy. Some of those purposes will mean we need to keep it for longer than usual, whereby we need to satisfy any legal, regulatory, tax, accounting or reporting requirements or resolve complaints. When we no longer have a good reason for holding it, we will delete or anonymise your information (so that it can no longer be associated with or identify you).

8. Security

We adopt robust technologies and policies to protect your information from being accidentally lost, used, altered, disclosed or accessed in an unauthorised way.

This Privacy Policy may be updated, amended, changed or supplemented from time to time, so please read it regularly. We’ll contact you or post a notice in the Driver App/s to let you know if there are any material changes. Once updated, the revised version of the Privacy Policy takes effect immediately upon it being published by us. Your continued use of the Driver App/s shall be considered express authorization from you for us to continue processing your personal information in accordance with it.
